Disclosure of Selection Criteria – The landlord is generally required to give applicants written notice of their selection criteria and possible grounds for an application’s denial. The applicant must sign an acknowledgment that this information was made available to them. [1]

Application Fee Refund – If an applicant wasn’t notified of the landlord’s selection criteria and their application is refused, they must have the application fee and any deposits refunded. [2]

Rejection of Applicant – A rental application is considered rejected if the landlord hasn’t given notice of acceptance within 7 days from:

Landlord’s Liability – When an application fee or deposit refund is required and the landlord refuses to do so, they will be liable for $100, plus three times the refund amount, and the applicant’s attorney’s fees. [4]

Waiver – Any provision of the rental application that attempts to waive the landlord’s liability under state law is void. [5]

Maximum Fees – Texas law sets no limit on the amount landlords may charge for deposits and fees.
